Authenticity

All objects offered for sale on INDIGOART AUCTIONS are authentic to the best of auction house knowledge.

INDIGOART AUCTIONS provides the following assurance to buyers  with regard to authenticity:

All objects

Objects offered for sale on Indigoart auctions are offered on behalf of a seller who may be a collector, dealer, retailer or gallery. Indigoart is selective in signing on suppliers with a strong history of quality and credibility.

Where Indigoart deems necessary, its team of experts examines the object’s provenance - including relevant documentation made available by the seller, and conducts independent research.

Sellers at Indigoart Auctions provide an assurance that the key characteristics described on the Indigoart Auctions website of such items, are accurate. In the rare instance that the authenticity of the item is questioned by a buyer, the claim is handled as below. for the following kinds of objects.

1. "Artworks" – including but not limited to paintings, prints, sculptures, installations and new media art.

2. "Precious Objects" – defined as jewellery, watches, loose precious stones, and any objects made of precious metals or precious stones.

3. "Other Objects" – defined as any objects not covered in (1) or (2).

Authenticity Guarantee for Artworks

Indigoart Auctions provides an assurance on behalf of the seller that each object we offer for sale is genuine and authentic.

Indigoart Auctions guarantees the authenticity of the Artwork for a period of one year. Authenticity in relation to Artworks shall mean compliance of the Artwork with the description provided on the web site, particularly with reference to the name of the artist, title (if any) of the Artwork itself, date, the school of art (if mentioned), dimensions, medium etc. In the unlikely event that within one year from the sale of the Artwork, it is proved by the buyer to the reasonable satisfaction of Indigoart Auctions that the item was not authentic and if, in Indigoart Auctions opinion, this would have significantly impacted the price a buyer would have been willing to pay for the item, Indigoart Auctions shall be entitled to rescind the sale and the seller will be liable to refund to the buyer the price paid for the item, once the buyer returns the item to Indigoart Auctions. Indigoart Auctions shall hand over to the seller the item returned by the buyer.

All such claims will be handled on a case-by-case basis, and in the case of an authenticity claim in relation to Artwork will require that examinable proof, which clearly demonstrates that the item is not authentic, is provided by an established and acknowledged authority. The decision of Indigoart Auctions in respect of such claims shall be final and binding.

Authenticity of Precious Objects and Other Objects

In the case of Precious Objects and Other Objects, Indigoart Auctions offers an assurance on behalf of the seller that the item shall comply with characteristics or features mentioned in the heading (title) of the item on the website, till such time that the item is in the possession of Indigoart Auctions (in the case of Precious Objects) and till 7 working days from the day the item has been delivered to the buyer (in the case of Other Objects). It is therefore advisable for buyers or potential buyers of such items, particularly if they are of high value, to request Indigoart Auctions for an inspection of the item. Indigoart Auctions will, to the extent practicable and commercially reasonable, coordinate with the sellers for any such request for inspection.

In the unlikely event that during such an inspection (in the case of Precious Objects) or within 7 working days from the day the item has been delivered to the Buyer (in the case of Other Objects), the buyer is able to prove to the reasonable satisfaction of Indigoart Auctions that the item does not match the details given in the heading to the item, and if, in Indigoart Auctions’s opinion, this error or omission would have significantly impacted the price a buyer would have been willing to pay for the item Indigoart Auctions shall be entitled to rescind the sale and the seller will be liable to refund to the buyer the Sale Price paid for the item. The buyer shall return the item to Indigoart Auctions and Indigoart Auctions shall hand over the item to the Seller upon refund of the sale price paid to him for the item. Once Indigoart Auctions obtains the refunded amount from the Seller, it shall forward the same to the buyer. This guarantee will not be applicable to Precious Objects where the item is being shipped to the buyer by Indigoart Auctions.

All such claims will be handled on a case-by-case basis. The decision of Indigoart Auctions in respect of such claims shall be final and binding.

Further Conditions

The above claims for Artworks, Precious Objects and Other Objects shall be subject to the following conditions:

1. The claim is made by the buyer as registered with Indigoart Auctions (the benefit of the claim is not assignable to any subsequent owners or others who may acquire or have an interest in any of the items).

2. The item is returned in the same condition that it was in at the time of delivery of the item to the buyer.

3. The item was indisputably purchased through Indigoart Auctions.

Indigoart Auctions t retains the right to consult with, at the expense of the buyer, two recognized experts in the field, (such experts being mutually acceptable to Indigoart Auctions and the buyer), to examine the item under question before deciding to rescind the sale and offer the refund under the above guarantee. The opinion of the experts shall not be binding on Indigoart Auctions  

In the event of the seller's failure to refund the proceeds as stated above, the buyer shall return the item to Indigoart Auctions and authorize S Indigoart Auctions as its agent to initiate legal proceedings against the seller. Any such steps taken or legal proceedings instituted by Indigoart Auctions against the seller shall be to the cost of the buyer
